Terms of use

These are the rules for using Setboard. They are an agreement between you and Bad Beta LLC, the company that makes Setboard. By creating an account or signing in, you agree to them. Please read them with the Privacy policy, which says what we do with your information.

Setboard runs under each gym's own name, colors and address, so these pages may be wearing a gym's brand. The gym chose Setboard to run its climbing pages; Bad Beta LLC runs the software. Your climbing at a gym is governed by that gym's own rules, waiver and staff, not by these terms.

Who may use Setboard

  • You must be 13 or older to use Setboard. We do not ask your age, but if we learn that an account belongs to a child under 13, we close it.
  • If you are under 18, you need a parent or guardian's permission, and they agree to these terms for you.
  • During the pilot, Setboard is offered in the United States only.
  • You may not use Setboard if we have closed an account of yours for breaking these terms, unless we say you may.

Your account

  • One account works at every gym on Setboard. You sign in with a link or a code sent to your email address, or with Google or Apple where offered.
  • Keep your email account secure. Anyone who can read your email can sign in as you. Do not forward a sign-in email or share a code.
  • Choose a display name that does not pretend to be someone else and that you are happy to have public: it is shown next to what you post.
  • You are responsible for what is done with your account. If you think someone else has used it, write to us at support@badbeta.app.
  • Log your own climbs honestly. Your logbook is yours, and gyms read the totals to decide what to set.

What you post

When you log an ascent, rate a route, suggest a grade, comment, add a video link, flag something, report a problem or send feedback, you are posting content.

  • It stays yours. You own what you write.
  • You give us and the gym a license to show it. You grant Bad Beta LLC and the gym where you posted it a worldwide, non-exclusive, royalty-free license to store, copy, display and adapt it (for example, to show it on a route page, count it in a route's rating, include it in the gym's own export, or fit it on a phone screen), for as long as Setboard or the gym keeps the route's history. That license continues after you close your account for what stays behind under "former member" (see Closing your account), because it is part of the gym's route history.
  • Only post what you have the right to post. A video link should be to a video you made or one its owner published for anyone to watch.
  • Do not post: anything unlawful, threatening, harassing or hateful; anyone's personal information (an address, a phone number, a surname they did not share); sexual content; spam or advertising; malware or links to it; content that infringes someone's copyright or other rights; or joke grades and fake logs meant to distort a route's numbers.
  • Beta is opinion. Comments, grades and videos are other climbers' views, and they can be wrong.

Moderation and muting

Each gym sets its own rules for what may be posted on its routes; ask the gym if you want to see them.

  • A gym's managers and admins may hide or remove a comment, a video link, a suggested grade or a rating that breaks the gym's rules or these terms, and may mute you at their gym, which stops you posting comments and links there for as long as the mute lasts. A mute affects that gym only. Every removal and mute is recorded with the reason given. A gym never removes your logged ascents.
  • We may remove content or disable an account that breaks these terms or the law, or that puts other people at risk. Where we can, we will tell you why.
  • Flags from other climbers ask the gym to look; they do not remove anything by themselves.
  • If you think something was removed by mistake, write to the gym, or to us.

Climbing is dangerous: Setboard is information, not a safety inspection

Climbing, including bouldering and roped climbing indoors, can cause serious injury or death. Setboard does not change that, and nothing in it makes a route, a hold, a wall or a piece of equipment safe.

  • Grades, beta, comments, videos, ratings, problem reports, "reported" warnings and "coming down soon" labels are information from setters and other climbers. They may be wrong, out of date or missing. A route with no problem report may still have a loose hold; a route shown as reported may already be fixed; a grade may not match how a route feels to you.
  • Setboard is not a safety inspection and is not monitored in real time. A problem report goes to the gym's setters to deal with when they can; it is not an emergency service. If something on the wall is dangerous, tell the gym's staff in person, straight away. In an emergency, call 911.
  • The gym's own rules, waiver and staff govern safety on the wall. Follow them. Check holds, equipment and your landing yourself, climb within your ability, and do not rely on anything you read in Setboard to decide whether something is safe.
  • Do not use Setboard while climbing or belaying.

Our part

  • We provide Setboard for free to climbers. We may change it, add or remove features, or stop offering it at a gym (for example, when a gym stops using it). If a gym leaves, your logbook keeps your climbs there.
  • We try to keep Setboard running and your data safe, but we cannot promise it will always be available or free of errors.
  • The Setboard name, software and design belong to Bad Beta LLC; a gym's name, logo and routes belong to the gym. These terms do not give you any right to use either except to use Setboard.

Things you must not do

Do not: try to get into accounts or data that are not yours; get around rate limits, mutes or other protections; scrape Setboard or copy it in bulk, beyond downloading your own logbook; interfere with how it works or put an unreasonable load on it; reverse engineer it except where the law allows; use it to send spam; or use it for anything unlawful.

Closing your account

  • You can close your account at any time from Settings, or ask us to do it. Your display name becomes "former member" everywhere, your sign-in is removed, and your private notes and goals are deleted. Your ascents, ratings, comments and video links stay under "former member", because they are part of each gym's route history. The Privacy policy has the details.
  • Download your logbook first if you want it: Settings has a CSV file of everything that is yours.
  • We may suspend or close your account if you break these terms, if the law requires it, if the account belongs to a child under 13, or to protect other people. We will tell you why where we can.

Disclaimers

Setboard is provided "as is" and "as available". To the fullest extent the law allows, Bad Beta LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that anything anyone posts on Setboard, including grades, beta, route information and problem reports, is accurate, complete or current.

Limitation of liability

To the fullest extent the law allows:

  • Bad Beta LLC is not liable for any injury, death, loss or damage that results from climbing, or from relying on anything in Setboard, including grades, beta, route information, problem reports or their absence. Your climbing is between you and the gym.
  • Bad Beta LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or profits.
  • Bad Beta LLC's total liability to you for any claim about Setboard is limited to one hundred US dollars ($100). Setboard is free to climbers, and this reflects that.

Some places do not allow some of these limits, so they apply to you only as far as the law allows. Nothing here limits liability that cannot be limited by law, such as for gross negligence or willful misconduct.

If there is a claim against us because of you

If someone makes a claim against Bad Beta LLC or a gym because of content you posted or your breaking these terms, you agree to cover the reasonable costs of it, as far as the law allows.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about Setboard or these terms will be decided in the state or federal courts located in California, and you and we agree to their jurisdiction. Before going to court, please write to us first: most problems are solved by an email.

Changes to these terms

The date this version took effect and what changed are at the top of this page. When we make a material change, we announce it in the app before it takes effect, and the next time you sign in we ask you to accept the new version. If you do not agree, you can close your account.

The rest

These terms and the Privacy policy are the whole agreement between you and us about Setboard. If a part of them cannot be enforced, the rest still applies. If we do not enforce a part straight away, we have not given it up. You may not transfer these terms to someone else; we may transfer them to a company that takes over Setboard.
